World Court Project UK is part of an international citizens' network which worked for five years to obtain an Advisory Opinion from the International Court of Justice (World Court) on the legal status of nuclear weapons.
On 8 July 1996 the Court announced that both the threat and use of nuclear weapons would generally be illegal under international humanitarian law.
What is more, the Court unanimously decided that "there exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control." All states should use their influence to expedite such negotiations.
All nuclear weapon states must now review their legal position and produce concrete proposals for the elimination of their nuclear arsenals. Any state policy which uses nuclear threat to project its own power or to protect its "vital interests" is completely outside the law.
World Court Project UK is working to raise awareness of the Court's Advisory Opinion and its implications among the media. We have a loose network of supporters and work closely with other anti-nuclear groups worldwide, including those willing to take non-violent direct action to uphold international law. We make a special point of providing information and practical help on a personal basis.
We have recently been collecting individual Affirmations of Freedom from Nuclear Weapons in 20 languages from individuals in several countries. These say "I do not accept that nuclear weapons can defend me, my country, or the values I stand for". Many of these Affirmations were signed electronically and it is these signatories which the WCP online list is intended for.
The nuclear-armed states have yet to honour their treaty obligation to start negotiations on global nuclear disarmament in good faith at an early date. To generate new momentum for total nuclear disarmament, we want to return to the World Court and ask what the obligation to negotiate nuclear disarmament in good faith exactly entails, and whether the nuclear weapon states are at present complying with this obligation. This would create new pressure on nuclear-weapon states and give the advocates of disarmament an important new tool to promote disarmament.
The World Court Project will therefore continue to collect Citizens Affirmations of Freedom from Nuclear Weapons. When the right time comes we hope to present these to the World Court as evidence of the desire of citizens for a world free from the menace of nuclear weapons.
World Court Project UK is part of Abolition 2000, a global network to eliminate nuclear weapons.
